Is it legal to use a name from a character (not the actor) off of a movie or novel, that is both first and last name? And it is still quite modern, so it is still copy righted.

Interesting question.

I think you can use the name, but you can't use the character. If the character bears too much resemblance to it's namesake, you would definatly be looking at legal problems.

The rational could be that the character was named after a known character from a book or movie by his parents… I think I’ve seen this in a movie.

The creator of the original character might not like you using his character’s name, but I don't know legally if he could do anything. Any lawyers on the board?

I think she is asking if it is legal to use the name of a character from a published/released work, as your stage name. Like "Homer Simpson".

Oh, in that case, I think you can. Still not positive.

I know you can't use as a SAG actor if someone else had it first.
