Can someone explain to me, does the180° rule, apply here ???

IMO, it's whatever the director wants.

I understand why it's a "rule"... and it has a big purpose. But all rules can be broken. And if the director is going after a certain effect, or trying to capture an emotion from the audience, or maybe trying to pan to a new angle that would be even weirder without breaking the 180° rule... then by all means, break the "rule".

Although, in that case, chances are the director will not break the 180° rule randomly. It'll probably be part of a succession of specific shots and angles.
